NIS2 readiness

NIS2 readiness for companies, public bodies and suppliers: from the scope check to the evidence

NIS2 requires the organisations in scope to manage cyber risks, check their suppliers and report significant incidents. Strategic supports the work step by step. First we establish whether and how the rules apply to you. Then we compare what you have with the ACN measures, write the plan and prepare the evidence.

Timeline of NIS2 notifications in Italy: early warning within 24 hours, notification within 72 hours, intermediate report on request and final report within one month (Legislative Decree 138/2024, Article 25).

Who falls under NIS2, and who receives it from clients

The rules apply directly to some organisations. Many more meet them as suppliers.

NIS2 is the EU Directive (EU) 2022/2555. In Italy it applies through Legislative Decree 138/2024, enforced by the ACN, Italy’s National Cybersecurity Agency. It covers organisations in the sectors listed in the annexes, as a rule medium-sized and large companies. For some activities, such as DNS services, size does not matter.

Italian public bodies in the categories of Annex III are covered too, whatever their size. They include regions, metropolitan cities, municipalities with more than 100,000 inhabitants, regional capitals and local health authorities.

Then there are suppliers. A supplier does not fall under NIS2 because its client does. The client, however, must manage the security of its direct suppliers, and asks for it through questionnaires, clauses and audits.

Typical scenario

A medium-sized engineering company supplies components to a group subject to NIS2. It receives a long questionnaire with only a few weeks to answer. Almost all the measures are in place, but none of them is written down.

The deadlines in brief

The phases of NIS2 readiness

Six steps. Decisions stay with the company, which approves every document.

Scope check

Sector, size and activities. We establish whether you are in scope, a supplier to entities in scope, or both. The conclusion is shared with your lawyer.

Gap analysis

What you have is compared with the ACN basic measures, one by one. For each measure we note what is missing and what only needs writing down.

Readiness plan

Priorities, owners and dates, in a document that management approves and that you can show.

Measures

The missing technical and organisational measures, with your IT team and suppliers. Where needed, with testing and penetration tests.

Evidence

Plans, policies, procedures, inventories and logs, kept up to date. They are the documents the ACN lists in its FAQs.

Notifications and leadership

The procedure for notifications to CSIRT Italia, an exercise with management and training for the management bodies.

How long does it take?
It depends on size, sector and starting point. We estimate it after the scope check. The first conversation carries no commitment. If there is work to be done, you receive a written proposal for the initial assessment, usually one or two days of work with the people involved. After the assessment comes the proposal for the project, with phases, timing and costs.
Who does what?
The company decides and approves. We analyse, write the documents with you and check them. IT or your suppliers implement the technical measures, with our support.

The required measures and the evidence that shows them

Updated 7 November 2026

In short: the measures are those of Article 24 of Legislative Decree 138/2024. The evidence is the set of documents the ACN lists in its FAQs.

Cyber incident response: the first steps

And a San Marino company?

  • NIS2 does not apply to the work done within the Republic. It covers a San Marino company if it offers digital services covered by the Directive in the EU and meets the criteria. In that case it designates a representative in a Member State. More often, it arrives as a request from Italian and EU clients.

What we don’t do

  • We don’t issue certifications. No certificate declares a company to be in line with NIS2 as a whole. We document measures and evidence.
  • We don’t replace your lawyer. The scope check and the notifications are settled with them.
  • We don’t write documents nobody applies. Every policy has an owner and a review date.
  • We don’t promise that nothing will happen. Readiness reduces the risks and prepares you to handle them.

Frequently asked questions about NIS2

How do we know whether a company falls under NIS2?
You cross-check two things. The first is the sector, compared with the annexes to Legislative Decree 138/2024. The second is size. As a rule, the law covers medium-sized and large companies, with exceptions such as DNS services, and the ACN can identify other entities. Those in scope register every year between 1 January and 28 February. It is best to share the conclusion with your lawyer.
We supply a company subject to NIS2. Does it concern us?
Being a supplier does not, on its own, create any direct obligation, unless your own activity also falls under the law, as managed services do. Your client, however, must manage the risks of its direct suppliers (Article 24 of Legislative Decree 138/2024). It will ask you through questionnaires, clauses and requests for evidence. The best answer is measures that have been tested.
How quickly must an incident be notified?
An entity subject to NIS2 sends CSIRT Italia an early warning within 24 hours of becoming aware of a significant incident, the notification within 72 hours and a final report within one month of the notification (Article 25 of Legislative Decree 138/2024). According to the ACN FAQs, the basic obligation applies from the ninth month after the notice of inclusion for organisations added in 2025, and from 1 January 2027 for those added in 2026.
Does Strategic issue a NIS2 certification?
No. No certificate declares a company to be in line with NIS2 as a whole. The law sets obligations supervised by the ACN, which can require European certification only for categories of ICT products, services or processes (Article 27). Strategic supports the readiness work and documents measures and evidence.
Do directors have to be trained?
Yes. In essential and important entities, the management bodies must follow cybersecurity training and promote regular training for staff (Article 23 of Legislative Decree 138/2024). They also approve the measures and are liable for infringements. Security training for staff
